Seeking information on where and how your affiliate/chapter/components are registered and file taxes. Our chapters use our business address in Maryland for purposes of IRS registration and filing. However, they are not registered as organizations with the State of Maryland. We understand that we will need to rectify this, but it has raised some other questions that we are now working on tracking down the answers to.
1. In addition to registering as an organization with the State of Maryland, which is the address on file with the IRS, are the chapters also required to register in the states where they "do business"? For example, does the Illinois chapter need to register as an organization in both Maryland and Illinois? If so, for chapters that work at the regional level, for example, Greater New England, what is the best way to determine which state(s) they need to register in?
2. Historically chapters file the federal 990. If they do need to register in both Maryland the states they are doing business, should we also be proactively advising the chapters that they need to file state-specific taxes as well?
